Five of her deputies then agreed to issue marriage licenses in her absence, and the Rowan County Clerk's Office also began doing so.

Elwood Caudill Jr.is the new Rowan County, Kentucky clerk, according to the Lexington Herald-Leader.

Davis, part of a denomination called Apostolic Christianity, made headlines in 2015 after she refused to issue marriage licenses to same-sex couples, despite a historic Supreme Court ruling that legalized same-sex marriages across the country the same year.

Both candidates say they do not think the national attention will influence the outcome of the election. Ermold is a gay man who was denied a marriage license by Davis in 2015.

The judge ordered her release days later, saying he was satisfied the office was issuing marriage licenses to "legally eligible couples".

After his loss, Ermold declined to throw his support behind Caudill, calling him a homophobe.

Davis has called Caudill to concede the race. Davis, a Democrat at the time, won the party's nomination by less than 25 votes against Caudill in 2014.
